Cynthia Hill March 24, 2013 Political Science Hames Partial Birth Abortion and Federalism With the Supreme Court decision on the right of a woman to abortion in 1973, controversy still looms heavy in the opinions of the people of America. The State of Texas was the subject of challenge by a single pregnant woman (Roe) on the constitutionality of the abortion laws. This famous Supreme Court Case Roe v. Wade was concluded that the fourteenth amendment was broken by the state of Texas. Roe won her case and federalism is displayed. Specifically the Due Process Clause â€Å"which prohibits state and local governments from depriving persons of life liberty or property without certain steps being taken to ensure fairness.† This case was decided in 1973 and was a big deal for the wo men in America. Women now had the right to choose whether they had a baby or not. It is after all their body and life. Prior to abortion being accepted there had been many illegal places to have an abortion which were unsanitary and performed by people who were not physicians. This was dangerous for women. Now a real doctor could perform the procedure and this was a long needed option for the women in America. Federalism took over and the states had to follow the decision of the Supreme Court ruling. There is a problem with the new right to a woman having an abortion and this problem is when an abortion should not be an option because the fetus is a baby and a life. Everything is developed and the third trimester is too late to perform an abortion. Or is it? The controversy today is over what is called partial birth abortions. A partial birth abortion happens in the third trimester of pregnancy when the fetus is close to full development. I think it is very necessary for a small towns or business to consider a sustainability plan. For starters to see how much waste they are producing. By eliminating the amount of waste produced, they could save money and contribute to cleaning up the environment. For small towns resources are limited, having a sustainability plan set in place can extend the resources. For businesses having a sustainability plan can also help with limited resources and the reputation of the business. Some of the cost savings small towns can obtain are energy and water. They can do this by changing all street and traffic lights to energy efficient bulbs. By getting the whole community to support the sustainability plan, the can achieve even more savings by having residents change all household bulbs to energy efficient bulbs. Residents can also change their appliance to energy efficient ones to keep the energy cost down for the entire town. Also, if the town gave rebates to residents who changed their faucets and toilets to energy efficient ones could lower the towns water cost. Preserving natural resources can be beneficial to small towns. Conserving wetlands can recharge underground water supplies. Maintaining the wilderness can help with keep building materials in high supply. These methods can help a town be more sustainable and preserve their natural resources to keep them healthy and productive. All states in this great nation have three basic branches of government known as the executive, legislative, and the judicial branch. California is no different. The Governor, Jerry Brown heads up the executive branch as a face for the people of California (California, 2013). Now we will look at the type of democracy that truly sets California aside from other states, direct democracy. With a general overview, a direct democracy is a broad term that encompasses an assortment decision processes, including town meeting, recall elections, initiatives, and referendums. The referendum is a process that allows the citizens to approve or reject laws of constitutional amendments proposed by the government. On the opposite side of a referendum, an initiative is the proposal of a new law or constitutional amendment by the ordinary citizens to the state government. No more than half of the states offer options of either, with twenty-five states offering popular referendum and only eight-teen states offering a recall (Bowman, 2012, p.82) This is what sets California apart from many of the other states that do not allow recall or initiatives.
